1. Definitions
For the purposes of these Terms & Conditions:
Company means Dany & Sons Wood Flooring Ltd, including its directors, employees, authorised representatives and approved subcontractors.
Customer means the individual, company or organisation entering into an agreement with the Company.
Quotation means the written quotation issued by the Company.
Works means all flooring installation, floor levelling, sanding, restoration, repairs, refinishing and any related services carried out by the Company.
Additional Works means any work not included within the original quotation or made necessary due to unforeseen site conditions or customer requests.
Materials means all flooring products, adhesives, primers, levelling compounds, trims, skirting boards and accessories supplied by the Company.
Property means the address where the Works are to be carried out.
Completion means the point at which the agreed Works have been substantially completed, excluding minor snagging items that do not affect the normal use of the flooring.
2. Quotations
All quotations are provided in writing and remain valid for 30 days, unless otherwise stated.
Quotations are based on the information supplied by the Customer together with the visible condition of the Property at the time of inspection.
Should measurements, specifications or site conditions change after the quotation has been issued, the Company reserves the right to revise the quotation accordingly.
No quotation shall become legally binding until it has been accepted by the Customer and confirmed by the Company.
3. Scope of Works
The quotation includes only the goods, labour and services specifically described within the written quotation.
Any item or service not expressly listed shall be deemed excluded.
Additional materials, labour or services requested by the Customer, or required due to unforeseen site conditions, shall be treated as Additional Works and charged separately.
The Company shall not be obliged to carry out Additional Works until the Customer has accepted the revised quotation or additional charges in writing.
4. Booking Confirmation
A booking shall only be confirmed once the required payment has been received.
Installation dates are allocated according to availability and remain provisional until confirmed in writing by the Company.
No flooring materials shall be ordered until the required deposit has been received.
The Company reserves the right to reschedule installation dates where circumstances beyond its reasonable control arise.
5. Payment Terms
To secure any booking, the Customer agrees to pay:
• Full payment for all materials before delivery or installation.
• 20% of the fitting (labour) cost before the Works commence.
For projects expected to take one or two working days, the remaining 80% of the fitting cost shall become payable immediately upon Completion.
For projects expected to exceed two working days, payment shall be made as follows:
• Full payment for materials before Works commence.
• 20% of the fitting cost before Works commence.
• 60% of the fitting cost during installation when requested by the Company.
• Final 20% immediately upon Completion.
No workmanship warranty shall become effective until all invoices have been paid in full.
The Company reserves the right to suspend the Works immediately where payments become overdue.
Late payments may result in debt recovery costs, legal fees and statutory interest where permitted under Irish law.
Ownership of all supplied materials shall remain with Dany & Sons Wood Flooring Ltd until full payment has been received.
6. Additional Works
Any work requested after acceptance of the original quotation shall be treated as Additional Works.
Additional Works shall be quoted separately and may require payment before commencement.
The Company reserves the right to extend the project completion date where Additional Works are requested.
7. Project Schedule
Estimated commencement and completion dates are provided for guidance only.
Whilst every reasonable effort shall be made to complete the Works within the estimated timeframe, completion dates cannot be guaranteed.
The Company shall not be liable for delays caused by:
• adverse weather conditions;
• supplier delays;
• drying and curing times;
• hidden defects;
• moisture or damp;
• structural movement;
• restricted site access;
• Customer delays;
• Additional Works;
• or any circumstances beyond the Company’s reasonable control.
8. Customer Responsibilities
The Customer agrees to:
• provide unrestricted access to the Property during agreed working hours;
• ensure the work area is clear before the Works commence;
• remove furniture and personal belongings unless otherwise agreed in writing;
• disclose any known defects, moisture issues or structural concerns;
• provide accurate project information and measurements where requested.
Failure to provide suitable access or adequate preparation may result in additional charges and the rescheduling of the Works.
9. Site Conditions
All quotations are based on the visible condition of the Property at the time of inspection.
Should hidden defects be discovered after the Works have commenced, including but not limited to damp, moisture, rotten timber, structural movement, defective subfloors, asbestos, hidden pipework or electrical issues, the Company reserves the right to suspend the Works and issue a revised quotation where necessary.
Any additional costs arising from unforeseen site conditions shall remain the responsibility of the Customer.
10. Floor Preparation & Levelling
Where floor levelling or subfloor preparation forms part of the agreed Works, the Company shall use professional materials suitable for the intended flooring installation.
The Company warrants only the preparation carried out by its own employees or authorised subcontractors.
Where floor levelling, screeding or subfloor preparation has been completed by third parties, the Company accepts no responsibility for the quality, moisture content, level or suitability of those works.
If hidden defects or unsuitable subfloor conditions are identified during the project, the Company reserves the right to suspend the Works until the issue has been resolved or to provide a revised quotation for any additional work required.
11. Materials & Installation
The Company shall supply and install all materials in accordance with the accepted quotation unless otherwise agreed in writing.
Wood flooring is a natural product. Variations in colour, grain, knots, texture and appearance are natural characteristics and shall not be regarded as defects.
Samples, brochures, photographs and online images are provided for guidance only. Minor differences between samples and the final installation may occur.
Where flooring materials are supplied by the Customer, the Company accepts no responsibility for their quality, suitability, compatibility or manufacturer defects.
No workmanship warranty shall apply to defects arising from customer-supplied materials.
12. Moisture, Environment & Drying Conditions
Wood flooring naturally expands and contracts depending on environmental conditions.
The Customer acknowledges that temperature, humidity, moisture levels, ventilation and underfloor heating may affect the performance and appearance of the flooring.
The Company shall not be responsible for movement, expansion, contraction, gaps, cupping, crowning or distortion resulting from:
• excessive moisture;
• plumbing leaks;
• flooding;
• rising damp;
• condensation;
• structural movement;
• insufficient ventilation;
• incorrect use of underfloor heating;
• failure to maintain suitable indoor conditions.
Drying and curing times for primers, adhesives, levelling compounds and finishes vary according to site conditions and manufacturer recommendations and remain outside the Company’s control.
13. Completion of Works
The Works shall be deemed substantially complete once the agreed installation is fit for its intended purpose.
Minor cosmetic touch-ups, snagging items or adjustments that do not affect the normal use of the flooring shall not delay Completion or final payment.
Where return visits are required due to drying times, curing periods or material availability, such visits shall not affect the Completion Date.
The Customer agrees to inspect the completed Works promptly and notify the Company of any concerns within a reasonable time.
14. Workmanship Warranty
Where both the flooring installation and any associated floor preparation have been carried out by Dany & Sons Wood Flooring Ltd, the Company provides a 2-year workmanship warranty, unless otherwise agreed in writing.
The workmanship warranty covers defects arising solely from faulty installation carried out by the Company.
The warranty does not cover:
• normal wear and tear;
• scratches or dents;
• accidental damage;
• misuse or negligence;
• flooding or plumbing leaks;
• excessive moisture;
• structural movement;
• customer modifications;
• poor maintenance;
• damage caused by pets;
• damage caused by furniture without protective pads;
• damage resulting from third-party works.
Manufacturer warranties remain the responsibility of the product manufacturer.
15. Warranty Conditions
If the Customer believes a defect is covered under the workmanship warranty, they must notify the Company in writing as soon as reasonably possible and allow the Company the opportunity to inspect the Works before any repairs are carried out.
No third party may repair, alter or modify the Company’s installation without prior written approval.
Unauthorised repairs or alterations carried out by others may invalidate the workmanship warranty.
The Company shall not be responsible for defects or damage resulting from repairs carried out by third parties.
16. Timber Movement
Timber is a natural material and will expand and contract with seasonal changes in temperature and humidity.
Minor gaps, slight movement and natural variation are normal characteristics of wood flooring and shall not be considered defects.
17. Underfloor Heating
Where underfloor heating is installed, the Customer is responsible for operating the system in accordance with the flooring manufacturer’s recommendations.
The Company accepts no responsibility for damage caused by incorrect operation, excessive temperatures or failure to follow the recommended heating protocol.
18. Customer-Supplied Materials
Where flooring materials, adhesives or accessories are supplied by the Customer, the Company accepts no responsibility for shortages, incorrect quantities, manufacturing defects, colour variations, delivery delays or product compatibility.
Any delays caused by customer-supplied materials may affect the installation schedule.
19. Photography & Marketing
The Customer acknowledges that the Company may photograph or video the completed Works for:
* quality control;
* warranty records;
* staff training;
* website portfolio;
* social media;
* advertising and marketing purposes.
The Company will take reasonable care not to include identifiable individuals or personal belongings.
If the Customer does not wish photographs of the completed flooring installation to be used, they must notify the Company in writing before the Works commence.
20. Cancellation & Rescheduling
If the Customer wishes to postpone or cancel the Works, reasonable notice must be given.
Materials that have already been ordered, manufactured or specially prepared cannot normally be cancelled and remain payable.
Where the Customer postpones the Works after materials have been ordered, the Company reserves the right to charge reasonable storage, administration or rescheduling costs.
Repeated postponements may result in the project being moved to the next available installation date.
21. Force Majeure
The Company shall not be liable for delays or failure to perform its obligations where such delays arise from circumstances beyond its reasonable control.
These include, but are not limited to:
* severe weather;
* flooding;
* fire;
* supplier delays;
* transport disruption;
* labour shortages;
* industrial action;
* government restrictions;
* utility failures;
* pandemics;
* accidents;
* any other force majeure event.
Where such circumstances occur, the estimated completion date shall automatically be extended without liability to the Company.
22. Limitation of Liability
To the fullest extent permitted under the laws of the Republic of Ireland, the Company’s total liability arising from any quotation, contract or Works shall be limited to the value of the relevant contract or the reasonable cost of rectifying defective workmanship, whichever is lower.
The Company shall not be liable for any indirect or consequential losses, including but not limited to:
* loss of income;
* loss of profit;
* business interruption;
* accommodation costs;
* storage costs;
* delays caused by third parties;
* inconvenience.
The Company shall not be responsible for damage resulting from:
* hidden defects;
* structural movement;
* plumbing failures;
* water ingress;
* rising damp;
* electrical failures;
* defective products supplied by third parties;
* misuse of the flooring;
* incorrect maintenance;
* works carried out by other contractors.
Nothing within these Terms & Conditions shall exclude or limit any liability that cannot legally be excluded under Irish law.
23. Complaints Procedure
If the Customer has any concerns regarding the completed Works, they agree to notify the Company in writing as soon as reasonably possible.
The Company shall be given a reasonable opportunity to inspect the Works before any third party is instructed to carry out repairs.
All genuine complaints will be investigated fairly, and the Company will aim to provide a reasonable solution within an appropriate timeframe.
24. Data Protection & Privacy
The Company collects and processes Customer information solely for the purpose of:
* providing quotations;
* arranging site visits;
* supplying materials;
* completing the agreed Works;
* processing payments;
* complying with legal obligations.
Personal information shall be processed in accordance with the Company’s Privacy Policy, the General Data Protection Regulation (GDPR), and applicable Irish data protection legislation.
Customer information will never be sold to third parties and will only be shared where necessary to complete the agreed Works or where required by law.
25. Electronic Communications
To ensure accuracy and avoid misunderstandings, the Company conducts quotations, booking confirmations, invoices, project updates and important communications primarily in writing.
Official communication may be provided through:
* WhatsApp;
* Email;
* Website Live Chat;
* Website Contact Forms.
Telephone conversations are intended for general enquiries only and shall not form part of any agreement unless confirmed in writing by the Company.
Electronic communications shall be deemed valid written communication between the Company and the Customer.
26. Customer Communication
The Company aims to respond to all enquiries as quickly as possible.
Due to the nature of our work, telephone availability may vary.
For the fastest response, Customers are encouraged to contact us via:

* Website Live Chat;
* Email;
* Online Quotation Form.
Where a telephone call is requested, a member of the Company’s team will return the call as soon as reasonably possible.
27. Privacy of Communications
All project information, quotations, photographs and documents exchanged between the Company and the Customer shall be treated as confidential and used solely for the purpose of providing the requested services, unless disclosure is required by law or expressly authorised by the Customer.
28. Furniture & Appliances
Unless otherwise agreed in writing, the Customer is responsible for removing all furniture, appliances and personal belongings before the Works commence.
Following completion, heavy furniture should only be returned once the Company confirms that the flooring, adhesives or finishes have sufficiently cured.
The Company accepts no responsibility for delays caused by furniture or appliances remaining within the working area.
29. Floor Protection & Maintenance
Following Completion, the Customer shall take reasonable care to protect the newly installed flooring.
The Company recommends:
* using felt pads beneath furniture;
* avoiding dragging heavy objects;
* using cleaning products specifically recommended for wood flooring;
* maintaining suitable indoor humidity levels;
* protecting the floor during any remaining building works.
Damage caused by improper use, incorrect maintenance or failure to follow these recommendations shall not be covered under the workmanship warranty.
30. Parking & Site Access
The Customer shall provide reasonable access and suitable parking close to the Property.
Where parking charges, permits or congestion charges apply, these costs may be charged to the Customer unless otherwise agreed in writing.
Restricted access, stairs, long carrying distances or other site limitations may affect installation times and additional charges may apply where appropriate.
31. Moisture Testing
Where moisture testing is recommended, installation shall not proceed until acceptable moisture readings have been achieved.
If the Customer instructs the Company to proceed against professional advice, such instruction must be confirmed in writing and may invalidate the workmanship warranty.
32. Third-Party Contractors
The Company accepts no responsibility for damage caused by electricians, plumbers, painters, kitchen installers, builders or any other third-party contractors working before, during or after the Company’s installation.
Any damage caused after Completion by third parties shall not be covered under the Company’s workmanship warranty.
33. Site Visits & Measurements
Measurements taken during a site visit are based upon the visible condition of the Property at the time of inspection.
The Customer agrees to notify the Company of any alterations, building works or changes made after the site visit.
If measurements or site conditions change before installation, the Company reserves the right to revise the quotation accordingly.
34. Customer Approval Before Installation
Before installation begins, the Customer shall inspect and approve all flooring materials delivered to the Property.
This includes:
* flooring type;
* colour;
* finish;
* board size;
* installation pattern.
Once installation has commenced, the Customer shall be deemed to have accepted the supplied materials.
35. Existing Flooring & Hidden Defects
Removal of existing flooring may reveal hidden defects not visible during the original inspection.
These may include:
* damp;
* rotten timber;
* cracked concrete;
* damaged joists;
* uneven subfloors;
* asbestos-containing materials;
* hidden services or pipework.
Any additional work required shall be treated as Additional Works and charged separately.
36. Customer Delays
Where delays are caused by the Customer, including:
* failure to provide access;
* late payments;
* changes to the agreed specification;
* additional work requests;
* failure to prepare the Property;
* delayed decisions,
the Company reserves the right to revise the installation schedule and charge any reasonable additional labour, transport or administration costs incurred.
37. Governing Law
These Terms & Conditions and any agreement between the Company and the Customer shall be governed by and interpreted in accordance with the laws of the Republic of Ireland.
Both parties agree to make every reasonable effort to resolve any dispute through discussion and negotiation before commencing legal proceedings.
Where legal proceedings become necessary, the courts of the Republic of Ireland shall have exclusive jurisdiction.

39. Changes to These Terms
The Company reserves the right to amend these Terms & Conditions from time to time.
The latest version published on the Company’s website shall apply to all new quotations, bookings and contracts issued after the publication date.
40. Acceptance of Terms
By accepting a quotation, paying a deposit, making any payment, requesting the Company to commence the Works or allowing the Company to carry out any work, the Customer confirms that they have:
* read these Terms & Conditions;
* understood these Terms & Conditions;
* accepted these Terms & Conditions in full.
These Terms & Conditions, together with the accepted quotation and any written amendments agreed by both parties, constitute the entire agreement between Dany & Sons Wood Flooring Ltd and the Customer.
No verbal agreement, promise or representation shall be binding unless confirmed in writing by the Company.
