Dany&Sons Wood Flooring LTD
1. Introduction
These Terms and Conditions govern all services provided by Dany&Sons Wood Flooring LTD. By accepting a quotation or booking our services, you agree to be bound by these terms.
2. Quotations and Pricing
• All quotations are valid for 30 days unless stated otherwise.
• Prices are based on the information provided at the time of quoting.
• Additional costs may arise where unforeseen issues are encountered, including but not limited to subfloor defects, moisture, or structural problems.
• Any variations requested by the customer may result in revised pricing and must be agreed in writing prior to commencement.
3. In-Person Quotations
• A fee of €50–€150 applies for in-person site visits and quotations, depending on location and time required.
• This fee will be deducted from the final project cost if the customer proceeds with Dany&Sons Wood Flooring LTD.
• If the customer does not proceed, the quotation fee is non-refundable.
4. Booking and Deposits
Deposit requirements vary depending on the scope of work:
• Labour-only projects: 20% deposit required, with the remaining balance due upon completion.
• Projects including materials: 20% deposit plus full cost of materials required upfront.
Work will not commence until the required deposit and/or materials payment has been received.
5. Scope of Work
• The scope of work will be detailed in the quotation or contract.
• Any additional work outside the agreed scope will be subject to additional charges and must be agreed in writing before commencement.
6. Customer Responsibilities
The customer agrees to:
• Provide safe and clear access to the work area
• Remove furniture and personal belongings unless agreed otherwise
• Ensure the site is suitable and ready for installation
• Inform us of any known issues such as dampness, uneven surfaces, or structural concerns
We are not responsible for delays or additional costs arising from failure to meet these requirements.
7. Subfloor Conditions
We are not responsible for issues arising from unsuitable subfloors, including unevenness, moisture, or structural defects.
Any required preparation or remedial work will be charged separately unless explicitly included in the quotation.
8. Installation and Materials
• Natural wood products may vary in colour, grain, and texture. These are natural characteristics and not defects.
• We will take reasonable care to achieve consistency but cannot guarantee exact matches.
• Acclimatisation of materials may be required prior to installation.
9. Timeframes and Delays
• All start and completion dates are estimates only.
• We are not liable for delays caused by factors outside our control, including weather, supplier delays, or site conditions.
10. Payment Terms
• Final payment is due immediately upon completion and prior to use of the installed flooring.
• We reserve the right to charge interest on overdue payments in accordance with applicable Irish and EU legislation.
• Failure to make payment may result in suspension of work, recovery action, and additional costs.
Completion is defined as the point at which the installation is substantially finished, even if minor snagging items remain.
11. Retention of Title
All materials supplied remain the property of Dany&Sons Wood Flooring LTD until full payment has been received.
We reserve the right to remove materials in the event of non-payment where legally permitted.
12. Warranty and Liability
• A 12-month workmanship warranty is provided from the date of completion.
• Manufacturer warranties apply to materials where applicable.
• Warranty excludes:
• Normal wear and tear
• Moisture-related damage
• Improper use or maintenance
Our total liability shall not exceed the total amount paid for the services.
13. Maintenance
The customer is responsible for proper care and maintenance of the flooring. Guidance will be provided upon completion.
14. Damage and Insurance
• We carry appropriate insurance.
• We are not responsible for pre-existing damage or hidden structural issues.
• Any damage directly caused by us will be repaired or compensated reasonably.
15. Cancellations and Refunds
• Cancellations must be made in writing.
• Deposits may be non-refundable where materials have been ordered or work scheduled.
• Costs already incurred will be deducted from any refund.
16. Complaints
• Any issues must be reported within 7 days of completion or discovery.
• We will aim to resolve all complaints promptly and fairly.
17. Right to Suspend or Refuse Work
We reserve the right to suspend or refuse work where:
• Site conditions are unsafe
• Customer responsibilities are not met
• Payments are not made as agreed
Any resulting delays or costs will be chargeable.
18. Force Majeure
We are not liable for failure to perform due to events beyond our control, including natural disasters, strikes, or supply chain disruptions.
19. Marketing and Photography
We reserve the right to take photographs of completed work for marketing purposes unless the customer requests otherwise in writing.
20. Governing Law
These Terms are governed by the laws of Ireland. Any disputes shall be subject to the jurisdiction of the Irish courts.
21. Amendments
We reserve the right to update these Terms and Conditions at any time. The latest version will be available upon request.
